Preamble

PORTELO protects the privacy of Internet users visiting its Site in its capacity as data controller within the meaning of Act no. 78-17 of January 6, 1978 as amended (hereinafter the "Data Protection Act") and the General Data Protection Regulation no. 2016/679 (hereinafter the "GDPR") of the European Parliament and of the Council of April 27, 2016.

Definitions

The terms defined below shall have the following meaning, whether used in the singular or plural:

" Personal Data " means with regard to Article 4 of the RGPD "any information relating to an identified or identifiable natural person (hereinafter referred to as a "data subject"); an "identifiable natural person" is deemed to be a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity;". Personal Data includes, in particular, data enabling Users to be identified. We would like to point out that electronic identification data enabling us to identify your connection terminal or the pages consulted on the Site during your browsing is generally insufficient on its own to identify you by name.

" Business Partners " refers to PORTELO's partners These are the following companies:

" Applicable Regulations " means all existing or future regulations and standards that are applicable to Users and the Site and in particular the legislation and regulations concerning the protection of Personal Data, including the French Data Protection Act (Loi Informatique et Libertés) and the RGPD.

"Data Controller " means PORTELO when it determines the purposes and means of processing Personal Data.

" Site ": refers to the site(s) whose URL address is: maribaytoulonplaisance.fr

" Terminal " refers to the various media through which the Site may be accessed. Terminals include smartphones, tablets, Internet-enabled microcomputers (PC or Apple) and any object connected/connectable to another object as well as to the Internet.

" You ", " Your ", " User(s) " refers to any person accessing the Site (e.g. visitors) and whose Personal Data may be collected during their visit to the Site.

Methods of collecting Personal Data

PORTELO collects your Personal Data directly or indirectly, in particular :

  • through Your Terminal (in particular: cookies, connection data);
  • via the Site's data collection forms, such as the contact section;
  • during navigation on the Site's pages.

1. Cookies

1.1 General information

When you visit the Site, information relating to your browsing may be recorded in "cookies" files installed on your Terminal.

A cookie is a file installed on Your Terminal by the server of the website visited, which records information relating to navigation on a website. The data thus obtained is intended to facilitate subsequent browsing on the said website and is also used to measure the number of visitors to the site.

1.4 Your choices regarding cookies

  • For Opera 6.0 and above: in the main menu, select "Settings", click on "Privacy & Security" in the sidebar and under "Cookies" select the options that suit you best.
  • For Safari: in the Safari menu choose "Preferences" > "Security" or "Privacy" and select the options you require.

However, don't forget to configure all the browsers on your various terminals (tablets, smartphones, computers...).

2. Purposes of processing Personal Data

The processing of Personal Data carried out by
PORTELO through the Site has the following specific purposes (hereinafter the "Purposes"):

  • process Your questions or requests for information or any other request (e.g. recruitment, quotation, student project, complaint);
  • Product information ;
  • Inform you about events;
  • Invite you to take part in surveys;
  • Allow you to follow the Site and its news (RSS feeds).

The information required by PORTELO to fulfill the purposes described above is indicated by an asterisk () on the various pages of the Site. If you fail to complete the fields marked with an asterisk (), you may be denied access to all or part of the services and features of the Site and your requests may not be taken into account.

Other information is optional and enables us to get to know You better and improve our communications and services to You. The information collected by
PORTELO includes Your surname, first name, postal address, e-mail address and telephone number.

3. Duration of retention of Personal Data

In order to comply with current regulations, the Personal Data collected is kept for a specific period of time. The duration of data retention must be proportionate to the Purposes described above.

Your Personal Data :

  • electronic identification: are kept for thirteen (13) months from the date of collection;
  • cookies are stored for a period of thirteen (13) months from the date of collection;

The Personal Data collected is deleted following the occurrence of one of the following events:

  • end of shelf life ;
  • exercise Your right of deletion in accordance with the regulations in force and the procedures specified in the article "Your rights of access to Your collected data" of the present Privacy Policy;
  • deletion of the Site by PORTELO for any reason whatsoever.

4. Recipients of Personal Data

In order to ensure the proper operation of the Site and in accordance with the Purposes, Personal Data may be transmitted to:

Business partners ;

  • PORTELO departments and/or divisions concerned;
  • services and/or departments of a company in the EIFFAGE Group to which PORTELO belongs;
  • services and/or management of a PORTELO facility or agency.

5. Sharing and disclosure of Personal Data

PORTELO will only transmit your Personal Data to a third party in the following cases:

  • You have given Your prior and express consent for the sharing of this information (e.g. for a special promotional event);
  • PORTELO receives a request from a judicial authority or any administrative authority empowered by law to disclose such information in accordance with the legal provisions in force.

6. Personal Data transmitted by the User without request from EIFFAGE

PORTELO asks you not to transmit any content that would not be solicited by a questionnaire or any other collection form, such as commercial information, advertising, personal creations, ideas, concepts, etc..

When You voluntarily provide Personal Data about Yourself, particularly in the case of multimedia content (photographs, videos, etc.), You undertake to provide accurate information that does not harm the interests or rights of third parties.

7. Safety measures

PORTELO makes every effort to protect Your Personal Data against damage, loss, misappropriation, intrusion, disclosure, alteration or destruction and has an IT security policy describing the means and rules of security applicable in compliance with the recommendations of the ANSSI and the ISO 27001 standard.

Procedures for the physical and electronic safeguarding of Personal Data collected on the Site are implemented in accordance with current French legislation on the protection of Personal Data.

PORTELO employees who, by virtue of their position, have access to Your Personal Data, undertake to maintain the strictest confidentiality in this respect.

However, PORTELO does not control all the risks associated with the operation of the Internet and draws Your attention to the existence of possible risks in terms of occasional loss of data or breach of confidentiality of data transiting via the Internet network. The information provided on the Site may be interrupted in the event of force majeure or other circumstances beyond PORTELO's control or for reasons beyond PORTELO's control.

8. Accuracy of Personal Data collected

You declare that you are fully aware of the importance of the accuracy of the Personal Data concerning You and provided through the Site.

You therefore undertake to provide only accurate Personal Data throughout your use of the Site and to update it immediately if one or more of these Personal Data changes during your use of the Site.

In this respect, You may make a request for access, rectification or total or partial deletion as provided in the article "Your rights of access to Your Personal Data collected" of this Privacy Policy.

9. Your rights of access to Your Personal Data collected

In accordance with the provisions of Article 13 of the RGPD, You have a general right of access, rectification and deletion of your Personal Data processed by PORTELO.

You may exercise this right by sending Your request to PORTELO's Data Protection Officer by e-mail (privacy.fr@eiffage.com) or by post to the address below, specifying Your request and enclosing proof of identity:

You have the right to limit the processing of Your Personal Data and the right to object to Your Personal Data being processed for legitimate reasons (with the exception of canvassing for which You may object without legitimate reasons).

You also have the right to lodge a complaint with a supervisory authority.

10. Unsubscribe from newsletter

The Site offers Users a free "Newsletter" to which You are free to subscribe. This Newsletter contains information about PORTELO's construction sites, news and new products.

If you no longer wish to receive the Newsletter, PORTELO offers you the possibility of unsubscribing:

  • by simply clicking on the link at the bottom of the Newsletter
  • or by e-mail to communication.concessions@eiffage.com, specifying the e-mail address you wish to unsubscribe from.

11. Use of data in the event of a change of control of the company

Personal Data collected by PORTELO may be transferred to third parties in the event of a change of control of the company, an acquisition, insolvency proceedings or a sale of the company's assets.

12. Personal Data Policy relating to minors

The Site is not intended for minors. However, access to the Site is not reserved for adults, as it does not contain any content forbidden to minors under the age of eighteen (18).
The Site's forms and questionnaires are not intended to collect information on minors. If information is collected on a minor via the Site, the minor's legal representative may contact PORTELO's communications department to rectify, modify or delete this information (see Article "Right of access, modification, rectification and deletion").

13. Liability

By using the Site, You agree to abide by the terms of this Privacy Policy.

As such, You are and shall remain responsible for any breach of this Privacy Policy and in particular for the confidentiality of Your Site Identification data and any unauthorized use of the Site.

To this end, You shall be liable for any financial penalties that may be imposed on PORTELO, in particular by any decision of a French administrative or judicial court, or by an independent administrative authority such as the Commission Nationale de l'Informatique et des Libertés (CNIL), following a breach by You of Your obligations under this Privacy Policy.

Furthermore, PORTELO shall not be held liable in the event of:
the voluntary or involuntary use of all or part of Your Personal Data by a third party;
in the event that the Personal Data are erroneous or not updated by You;
failure to comply with Your obligations under the French Data Protection Act, this Privacy Policy and other contractual documents applicable to You.

14. Privacy Policy Update

PORTELO may modify its Privacy Policy from time to time. Such updates will be made without prior notice and posted online.

The previous Privacy Policy will then be automatically terminated and replaced by the new version, which will be immediately enforceable against any User. Use of the Site is subject to the Privacy Policy in force at the time of use.

As changes may be made to the Privacy Policy, we invite You to visit the "Personal data" section regularly.

16. Complete

In the event that one of the clauses of the present Privacy Policy should become null and void, in particular as a result of a change in legislation or a court decision, this shall in no way affect the validity of and compliance with the other clauses of the present Privacy Policy.

17. Applicable law and competent courts

This Privacy Policy is governed by French law.

IN THE EVENT OF ANY DISPUTE ARISING IN CONNECTION WITH THE VALIDITY, PERFORMANCE OR INTERPRETATION OF THE CONFIDENTIALITY POLICY, EXPRESS JURISDICTION SHALL BE ALLOCATED NOTWITHSTANDING PLURALITY OF DEFENDANTS APPEAL FOR WARRANTY, EVEN FOR EMERGENCY OR CONSERVATIVE PROCEEDINGS IN REFERENCE OR BY REQUEST TO THE COMPETENT FRENCH COURT.

IN CASES WHERE A RULE OF PUBLIC ORDER UNDER FRENCH LAW GRANTS EXCLUSIVE JURISDICTION TO ANOTHER COURT, IN WHICH CASE THE COMPETENT COURT WILL BE THE ONE SO DESIGNATED.
